WASHINGTON (AP) — A federal appeals court sided Friday with the Justice Department in a case that could have upended hundreds of charges brought in the Capitol riot investigation.

A divided three judge panel of the U.S. Court of Appeals for the District of Columbia Circuit said a lower court judge was wrong in dismissing the obstruction of Congress offense after concluding that the rioters’ conduct wasn’t covered by the charge in three cases.

The splintered decision raises questions about DOJ’s ability to sustain charges of obstructing an official proceeding.

But Judge Florence Pan, who wrote the majority opinion, said it was the wrong time to decide that broad question because the three defendants whose cases were before the court were all also charged with assaulting police. There’s little question that those who assaulted police that day acted with “corrupt intent.” But in Jan. 6 obstruction cases that don’t involve assault, determining “corrupt intent” is much more complicated, she said.

“It is more prudent to delay addressing the meaning of ‘corrupt’ intent until that issue is properly presented to the court,” Pan wrote, pointing to the pending appeal of Jan. 6 defendant Thomas Robertson — a former Virginia police officer who was convicted of obstruction by a jury — as one potential vehicle. Pan was appointed to the appeals court by Joe Biden.

Absolutely. Those types of groups are magnets for gov infiltrators.
...and I'd even add unarmed groups that are simply Rights-minded and seek to educate others with the intent of holding gov accountable, are also subject to such surveillance and infiltration.

If in one, always make clear that you are only interested in legal and Constitutionaly protected activities.

Which should mean the same thing as simply telling the truth.

ALEXANDRIA, Va. (AP) — A former Navy reservist who stormed the U.S. Capitol on Jan. 6, 2021, and expressed admiration for Adolf Hitler was sentenced Thursday to three years in prison on firearms charges.

The sentence U.S. District Judge Michael Nachmanoff imposed for Hatchet Speed in federal court in Alexandria was just five months less than the term sought by federal prosecutors and much longer than the one-year term sought by Speed's lawyers.

Yeah but you are supposed to be aware or be made aware of that BEFORE going to a protest, any protest. Even losers like Al Sharpton would warn his people to be on the alert for cops posing as protestors. Governments have been infiltrating protests for centuries this isn't a first.

A man whose television was continuously tuned to Fox News, and who knew “next to nothing” about the 2020 election, has been sentenced to seven years in federal prison for his part in the Jan. 6 Capitol riot.

Patrick McCaughey III participated in “some of the worst violence inside the lower west tunnel,” crushing an officer with a police shield, NBC News reported Friday. The prosecutor had asked for a hefty 15-year sentence, which would have been the longest term given to a Capitol rioter. The judge in the case, Trevor McFadden, is a Trump appointee.

McCaughey’s sister wrote a letter to the court explaining that her brother had been “radicalized” by their father, who only played “Fox News and Turner Classic Movies” in their home. She wrote that McCaughey’s “entire livelihood depended on having a good relationship with my father.”

CBS News reporter Scott MacFarlane reported Monday evening that the Justice Department is asking for the worst sentence yet of a Jan. 6 defendant.

Citing the sentencing memo, MacFarlane said that Pete Schwartz "stole chemical munitions, including pepper spray.. left behind by the fleeing officers and used that pepper spray as a weapon to attack those same officers as they desperately tried to escape"

Not a small group that was duped, lied to and conned by a crook. It was an entire country. And I honestly believe Trump and his cohorts will be held to account for their bullshit lies.

Wasn't just hippies. Think back to all the different movements going on back then. While a lot of the different movements were American, some were worldwide.

While a lot of the movements / groups were counter culture some simply wanted decent living conditions and human rights for their own kind.

One that impressed me with their organizational skills was the Nation of Islam. They set up food kitchens, schools, co-operative food buying programs, churches, etc. and probably have their own army.

The SDS were a bit radical but were very well organized.

The Minutemen were radical but well organized and may very well have been the spear head of the militia movement.

Could go on and on. Great time to grow up..........in my opinion.

Also a great time for shortwave listening.

Edit to add: Not only did the minutemen spear head the militia movement but they were the beginning of the survivalist movement. imo

Of course they were genuinly pissed off people who got caught up with a cult figure who didn't give a dam about his most loyal supporters. lesson to be learned, or not.

ATexas man facing charges in the Jan. 6 riot opened fire last week on sheriff’s deputies who had gone to his home to check on him ahead of his scheduled surrender to the FBI, according to new criminal complaint.

Nathan Donald Pelham of Greenville, who initially faced four misdemeanor charges tied to the insurrection, now faces an additional felony charge of being a felon in possession of firearm following the April 12 incident, a criminal complaint filed this week shows.

 
I remember reading the Q cope that all these protestors breaking the law were either actors or antifa, seems they were real people after all.

Jonathan Joshua Munafo, 36, of Albany, New York pleaded guilty Friday “to assaulting, resisting, impeding or interfering with an officer of the U.S. government; knowingly entering or remaining on restricted grounds without lawful authority and while carrying a dangerous weapon; and violent entry and disorderly conduct on Capitol grounds,” the Department of Justice reported.

 
*Watched the interview on 60 Minutes last night. My take is Epps would not be in the position he's in had he not have believed a lying con artist and showed up in DC, said and did the things he did.

A participant in the Jan. 6, 2021, protest at the U.S. Capitol has accused Fox NewsTucker Carlson of being “obsessed with me” and trying to “destroy my life.”

Ray Epps has been the target of a right-wing conspiracy theory scapegoating him for the violence that day by claiming he attended the protest as an FBI informant to provoke supporters of former President Donald Trump. Epps has not been charged in connection to the attack, as he was not seen engaging in violence and did not breach the Capitol.

Christian Matthew Manley, 27, of Fort Walton Beach, Florida, was sentenced Tuesday in federal court in the District of Columbia, according to court records. He pleaded guilty in November to assaulting, resisting and impeding law enforcement while using a dangerous weapon.


According to court documents, Manley joined with others in objecting to Democrat Joe Biden’s 2020 election victory over then-President Donald Trump. A mob stormed the Capitol in an attempt to stop Congress from certifying election results for Biden over Trump, a Republican, authorities have said. Five people died in the violence.
