Court sides with Justice Dept. on Jan. 6 obstruction charge

Story by By LINDSAY WHITEHURST and ALANNA DURKIN RICHER, Associated Press • 16m ago

WASHINGTON (AP) — A federal appeals court sided Friday with the Justice Department in a case that could have upended hundreds of charges brought in the Capitol riot investigation.

A divided three judge panel of the U.S. Court of Appeals for the District of Columbia Circuit said a lower court judge was wrong in dismissing the obstruction of Congress offense after concluding that the rioters’ conduct wasn’t covered by the charge in three cases.

Appeals court ruling puts hundreds of Jan. 6 felony cases in limbo

The splintered decision raises questions about DOJ’s ability to sustain charges of obstructing an official proceeding.

But Judge Florence Pan, who wrote the majority opinion, said it was the wrong time to decide that broad question because the three defendants whose cases were before the court were all also charged with assaulting police. There’s little question that those who assaulted police that day acted with “corrupt intent.” But in Jan. 6 obstruction cases that don’t involve assault, determining “corrupt intent” is much more complicated, she said.

“It is more prudent to delay addressing the meaning of ‘corrupt’ intent until that issue is properly presented to the court,” Pan wrote, pointing to the pending appeal of Jan. 6 defendant Thomas Robertson — a former Virginia police officer who was convicted of obstruction by a jury — as one potential vehicle. Pan was appointed to the appeals court by Joe Biden.

This from @Goldhedge 's post above is worth repeating and cannot be stressed enough.

"Anybody telling you to form a militia or an armed group that then tries to talk about how its time to storm government buildings is SETTING YOU UP."

Absolutely. Those types of groups are magnets for gov infiltrators.
...and I'd even add unarmed groups that are simply Rights-minded and seek to educate others with the intent of holding gov accountable, are also subject to such surveillance and infiltration.

If in one, always make clear that you are only interested in legal and Constitutionaly protected activities.

Which should mean the same thing as simply telling the truth.

Navy veteran who stormed Capitol gets 3 years on gun charges

Story by By MATTHEW BARAKAT, Associated Press • Yesterday 12:56 PM

ALEXANDRIA, Va. (AP) — A former Navy reservist who stormed the U.S. Capitol on Jan. 6, 2021, and expressed admiration for Adolf Hitler was sentenced Thursday to three years in prison on firearms charges.

The sentence U.S. District Judge Michael Nachmanoff imposed for Hatchet Speed in federal court in Alexandria was just five months less than the term sought by federal prosecutors and much longer than the one-year term sought by Speed's lawyers.

and expressed admiration for Adolf Hitler
How does that statement fit into the charges?

'Stormed' the capitol?

Words have power... that's why they call it 'spelling'.

We all know the whole operation was planned in advance by the PTB. We're not stupid out here in flyover country.

Yeah but you are supposed to be aware or be made aware of that BEFORE going to a protest, any protest. Even losers like Al Sharpton would warn his people to be on the alert for cops posing as protestors. Governments have been infiltrating protests for centuries this isn't a first.

Fox News Viewer Who Crushed Cop With Shield at Jan. 6 Riot Sentenced to Seven Years in Prison

Story by Jennifer Bowers Bahney • 4h ago

A man whose television was continuously tuned to Fox News, and who knew “next to nothing” about the 2020 election, has been sentenced to seven years in federal prison for his part in the Jan. 6 Capitol riot.

Courtesy U.S. Attorney’s Office for the District of Columbia
Patrick McCaughey III participated in “some of the worst violence inside the lower west tunnel,” crushing an officer with a police shield, NBC News reported Friday. The prosecutor had asked for a hefty 15-year sentence, which would have been the longest term given to a Capitol rioter. The judge in the case, Trevor McFadden, is a Trump appointee.

McCaughey’s sister wrote a letter to the court explaining that her brother had been “radicalized” by their father, who only played “Fox News and Turner Classic Movies” in their home. She wrote that McCaughey’s “entire livelihood depended on having a good relationship with my father.”

Hippie anti war protest organizers 1968;
Hey watch out for the man posing as one of us trying to cause trouble.

Jan 6th protest organizers 2021;
Stop the steal protest in DC ! Be there it's going to be wild! Trust The Plan!

That's how you get seven year prison sentences.

DOJ identifies Pete Schwartz as the worst Jan. 6 attacker prosecuted to date — and asks for 24 years

Story by Sarah K. Burris • Yesterday 10:00 PM

CBS News reporter Scott MacFarlane reported Monday evening that the Justice Department is asking for the worst sentence yet of a Jan. 6 defendant.

Citing the sentencing memo, MacFarlane said that Pete Schwartz "stole chemical munitions, including pepper spray.. left behind by the fleeing officers and used that pepper spray as a weapon to attack those same officers as they desperately tried to escape"

Hippie chicks were great!!
Those hippie protestors had more common sense than the stop the steal fools.

"stole chemical munitions, including pepper spray.. left behind by the fleeing officers and used that pepper spray as a weapon to attack those same officers as they desperately tried to escape"

Is it considered 'stealing' when something is left behind?

Your just creating martars at this point.

searcher? I do not agree with what the hippie movement was about not sure it was even genuine, maybe the beatnicks were real. My point is even the hippie movement had better organizers then the Jan 6th crew.

Wasn't just hippies. Think back to all the different movements going on back then. While a lot of the different movements were American, some were worldwide.

https://www.history.com/topics/1960s

While a lot of the movements / groups were counter culture some simply wanted decent living conditions and human rights for their own kind.

One that impressed me with their organizational skills was the Nation of Islam. They set up food kitchens, schools, co-operative food buying programs, churches, etc. and probably have their own army.

The SDS were a bit radical but were very well organized.

The Minutemen were radical but well organized and may very well have been the spear head of the militia movement.

Could go on and on. Great time to grow up..........in my opinion.

Also a great time for shortwave listening.

Edit to add: Not only did the minutemen spear head the militia movement but they were the beginning of the survivalist movement. imo

By the way thanks for continuing to report on these convictions searcher. The Qvidians at GIM tried to brush these people under the rug saying they were actors or antifa. Of course they were genuinly pissed off people who got caught up with a cult figure who didn't give a dam about his most loyal supporters. lesson to be learned, or not.

And the numerous undercover FEDS and Antifa leading the way? How do you feel about them?

ATexas man facing charges in the Jan. 6 riot opened fire last week on sheriff’s deputies who had gone to his home to check on him ahead of his scheduled surrender to the FBI, according to new criminal complaint.

Nathan Donald Pelham of Greenville, who initially faced four misdemeanor charges tied to the insurrection, now faces an additional felony charge of being a felon in possession of firearm following the April 12 incident, a criminal complaint filed this week shows.

I remember reading the Q cope that all these protestors breaking the law were either actors or antifa, seems they were real people after all.

From the link:

A man who was sentenced in October to two years in prison for threats to emergency dispatch personnel has now pleaded guilty to assaulting officers during the January 6 riot at the U.S. Capitol.

Jonathan Joshua Munafo, 36, of Albany, New York pleaded guilty Friday “to assaulting, resisting, impeding or interfering with an officer of the U.S. government; knowingly entering or remaining on restricted grounds without lawful authority and while carrying a dangerous weapon; and violent entry and disorderly conduct on Capitol grounds,” the Department of Justice reported.

*Watched the interview on 60 Minutes last night. My take is Epps would not be in the position he's in had he not have believed a lying con artist and showed up in DC, said and did the things he did.

Jan. 6 Protester Says Tucker Carlson Is Trying To 'Destroy My Life'

Story by Josephine Harvey • 1h ago

A participant in the Jan. 6, 2021, protest at the U.S. Capitol has accused Fox NewsTucker Carlson of being “obsessed with me” and trying to “destroy my life.”

Ray Epps has been the target of a right-wing conspiracy theory scapegoating him for the violence that day by claiming he attended the protest as an FBI informant to provoke supporters of former President Donald Trump. Epps has not been charged in connection to the attack, as he was not seen engaging in violence and did not breach the Capitol.

Christian Matthew Manley, 27, of Fort Walton Beach, Florida, was sentenced Tuesday in federal court in the District of Columbia, according to court records. He pleaded guilty in November to assaulting, resisting and impeding law enforcement while using a dangerous weapon.

According to court documents, Manley joined with others in objecting to Democrat Joe Biden’s 2020 election victory over then-President Donald Trump. A mob stormed the Capitol in an attempt to stop Congress from certifying election results for Biden over Trump, a Republican, authorities have said. Five people died in the violence.

Just curious how many officers plead guilty to firing flash bangs and gas into the crowds??

DES MOINES, Iowa (AP) — An Iowa woman who entered the U.S. Capitol during the Jan. 6, 2021, insurrection was sentenced Monday to five months in prison.

Deborah Sandoval, 56, pleaded guilty in December to entering a restricted building. In exchange for her plea, several other counts were dropped.

Just went through this whole thing.

Turning a blind eye to obvious inustice and two-tiered justice because the result of these predations fulfills your hopes... is not something a just and honorable person could do.

Libs actually BOMBED offices in DC. No big thing. Remember?

Agitators in many places in J6 -- GOVERNMENT AGITATORS, named agitators are recorded in pictures and video. Murder was committed by a government thug.

To not notice, or to dismiss as anything other than outright TREASON on the part of the many, many government "fake activists" (eg: far more "FBI Proud Boys" than Proud Boys showed up) is to actually support the evil totalitarian world elite rule.

The DOJ/FBI/CIA/IRS/MSM/Social media have been publicly exposed to anyone reading this as having been weaponized by one faction of the government.

Only someone who cannot think, or is a total fool, or is without any sort of moral compass could and would ignore the government secretly rioting and blaming its citizens. Only.

To remain silent as 50 screens showing news with all stations speaking exactly the same words... and later to have the MSM lying dupicity exposed and shoved down one's throat that all 50 screens were parroting Big Brother Speak -- and then later to forever shelve and "forget" it when some convenient "look over there!" thing comes up... is weak-minded.

To those who succor the evil, and defend it, I say:

Voter fraud is real. We ALL know that. The STASI Left has gone all the way to the "get the previous president for ANY crime, but, Goddammiit, GET HIM!!" We all know that, too.
