A Proposal to End the Russo-Ukrainian War​

With Russian forces performing so poorly in Ukraine, it is not surprising that Russian foreign minister Sergei Lavrov recently spoke about how Moscow is “ready” to negotiate an end to the war. Lavrov indicated that Russia has two conditions for an agreement, however, he also made clear that Moscow hopes to gain from negotiations with the West what it cannot win on the battlefield from Ukraine.

As reported by Newsweek, one of Lavrov’s conditions for negotiating is that the West “fully take into account the interests of the Russian Federation and its security.” Another is that the West would need to “offer us some serious approaches that will help defuse tensions.” The first of these two conditions amounts to a Russian demand that the West (especially the United States) accept at least some of Moscow’s territorial claims in Ukraine as well as that Ukraine does not join NATO. The second condition appears to be a demand that the United States and other Western governments come up with a mechanism to enforce Ukrainian acceptance of any agreement between Russia and the West ending the conflict.

Unsurprisingly, neither the United States nor the Ukrainian government is willing to take Lavrov up on this offer. Ukrainian president Volodymyr Zelenskyy has previously laid out his own conditions for negotiating a settlement, including the punishment of Russia through further sanctions, an end to its role as a permanent member of the United Nations (UN) Security Council, and international security guarantees for Ukraine. Needless to say, Russian president Vladimir Putin is unlikely to accept any of these conditions.

In the wake of the controversies and heated debate generated in the wake of the referenda held last September in the regions of Donbass, it became necessary to get some clarity on the legal issues surrounding this event.

A graduate of Harvard Law School, Dr. Alfred de Zayas served as the first UN Independent Expert on the Promotion of a Democratic and Equitable International Order, appointed by the United Nations Human Rights Council (2012-18). He worked with the United Nations from 1981 to 2003 as a senior lawyer with the Office of the UN High Commissioner for Human Rights, Secretary of the UN Human Rights Committee, and the Chief of Petitions.

Arnaud Develay: What is your analysis of the predicament facing Russian-speaking minorities living in the Donbass regions in the wake of the events of the Maidan? Could the actions of the Ukrainian government these past eight years be constitutive of an attempt to commit genocide on these populations?

Alfred de Zayas: The Russian population in Donbass certainly had reason to feel threatened in the light of the virulence of the anti-Russian rhetoric by the leaders of the Maidan coup and the anti-Russian legislation adopted by the putsch-Parliament.

The level of hatred expressed by politicians and media certainly constituted “hate speech” and violated article 20 of the International Covenant on Civil and Political Rights (ICCPR), which prohibits both propaganda for war and incitement to hatred and discrimination.

The shelling of population centers in Donbas 2014-2022 entailed war crimes and crimes against humanity, but did not amount to genocide for purposes of the 1948 Genocide Convention.

While Art. 2 of 1948 of the Genocide Convention has 5 categories, it does not include cultural genocide. It is wiser to avoid hyperbole. War crimes and crimes against humanity under articles 7 and 8 of the Statute of Rome are bad enough.

The right to speak one’s language is protected in articles 2 and 27 of the ICCPR. It is also protected in articles 2 and 15 of the International Covenant on Economic Social and Cultural Rights (ICESCR) and numerous UN resolutions. Moreover, it constitutes a legitimate exercise of the right of freedom of expression under article 19 ICCPR.

Ukraine is certainly in violation of articles 19 and 27 ICCPR.

Moreover, Ukraine is in violation of common article 1 of the ICCPR and ICESCR, which stipulates the right of self-determination of ALL peoples, necessarily including the Russian populations of Crimea and Donbas. Art. 1 reads as follows:

We might see the world through different glasses, but I'm actually a very easy going dude with a strong emotional keel. Abide the forum guidelines (especially the part about being respectful to people) and we're cool.

I understand you have swallowed the West's view of Russia. Fine. Whatever makes you feel good.

I'm not going to argue with anyone about the situation in Ukraine. The West wants to destroy and run roughshod over the Russian Federation. Anything less is not acceptable to the warmongers who control us. I will not approve of it nor applaud the bastards that have been financing this war. Folks who are so inclined can cuddle up to Lindsey Graham and the others who are waving their Ukraine flags. I won't be one of them.

The USA is on the wrong side of this Ukraine situation and I believe history will prove that to be true.

They just overthrew Brazil and Israel's elections, as well as the 2020 US elections. I'm swagging here, but I'll bet that's why the EU is shit as well.

Here is a good interview with Martin Armstrong going into a bit of History on Putin. Really Putin came to power BECAUSE the Clinton's / Bankers were trying to take over Russia. That pretty much automatically makes him a long time enemy of these people. I would like to know which document he found on this and read a copy.

Yet to read, but from what I recall... because of the downfall of the USSR there was 'opportunity' in the ensuing confusion and the oligarchs/mafia swept in like pirañas and basically "stole the store" leaving Russia and Russians poorer for the experience.

Putin is no friend of the oligarchs. He could care less that the west is stealing their yachts and accounts. The west is doing him a favor!
